Last Updated: September 21, 2026
These Terms & Conditions (“Terms”) govern your access to and use of the E-LAND Mobility website, online store, products, services, customer accounts, and related services (collectively, the “Services”).
E-LAND Mobility, operated by E-LAND Mobility, DBA Eland Micromobility (“E-LAND Mobility,” “E-LAND,” “we,” “us,” or “our”), provides electric bicycles, electric motorcycles, electric scooters, micromobility products, parts, accessories, merchandise, repair and service work, and related products and services.
By accessing our website, creating an account, submitting an order, purchasing a product or service, placing a deposit or pre-order, requesting service, or otherwise using our Services, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and all policies incorporated into these Terms.
If you do not agree to these Terms, you must not use our Services or purchase products from E-LAND Mobility.
1. ACCEPTANCE OF TERMS

-
You will comply with all applicable federal, state, and local laws;
-
You will use our products only for their intended purpose and in accordance with applicable manufacturer instructions, warnings, and laws.
Certain products may have additional age, licensing, registration, insurance, equipment, or operating requirements. It is the Customer's responsibility to determine and comply with all requirements applicable to the Customer and the location where the product will be used.
2. RELATED POLICIES
The following policies, as applicable, are incorporated into these Terms by reference:
-
Return & Refund Policy;
-
Warranty Policy;
-
Shipping Policy;
-
Privacy Policy;
-
Pre-Order Policy or Pre-Order Disclosures;
-
Product Purchase Acknowledgment;
-
Service, Repair, and Diagnostic Terms;
-
Any applicable financing agreement or third-party financing terms;
-
Any product-specific disclosures, waivers, acknowledgments, or agreements presented to the Customer.
If there is a conflict between these Terms and a specific written policy or agreement applicable to a particular transaction, the more specific transaction-specific provision will control to the extent permitted by law.
3. CHANGES TO THESE TERMS
We may modify, update, or replace these Terms from time to time.
Updated Terms become effective when posted on our website unless a different effective date is stated.
The Terms applicable to a particular purchase will generally be the version in effect at the time the transaction is completed, except where a later modification is required by law or expressly agreed to by the Customer.
Your continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms for future use and transactions.
4. WEBSITE AND E-COMMERCE PLATFORM
Our online store may be hosted or supported by third-party service providers, including Shopify Inc.
Third-party platforms may have their own terms, policies, privacy practices, and technical requirements. E-LAND Mobility is not responsible for the independent acts, omissions, outages, or policies of third-party platforms that are outside our reasonable control.
5. PRODUCTS, PRODUCT INFORMATION, AND SPECIFICATIONS
We make reasonable efforts to provide accurate product descriptions, photographs, specifications, pricing, availability, measurements, performance information, and other product information.
However:
-
Product photographs may not exactly represent the product received;
-
Colors, finishes, components, graphics, and accessories may vary;
-
Manufacturers may change specifications, components, colors, features, firmware, or designs without notice;
-
Manufacturer specifications may change after publication;
-
Advertised range, speed, battery life, charging time, payload capacity, and other performance figures may vary based on rider weight, terrain, temperature, riding conditions, riding style, battery condition, tire pressure, maintenance, speed, wind, elevation, and other factors;
-
Performance specifications supplied by manufacturers are not necessarily guaranteed real-world performance;
-
Product availability is subject to change.
Unless expressly stated otherwise in writing, E-LAND Mobility does not guarantee that a product will achieve a particular range, speed, charging time, or other performance result under every condition.
6. PRICING AND PRICING ERRORS
Prices displayed on our website, advertisements, invoices, quotations, or other materials are subject to change.
We reserve the right to correct typographical, pricing, promotional, inventory, or product-description errors.
If an order is placed based on a material pricing or product information error, we may cancel the order and refund amounts actually paid for the affected order, unless otherwise required by law.
Promotional pricing, discounts, financing offers, rebates, manufacturer incentives, and other promotions may be subject to additional terms, eligibility requirements, expiration dates, quantity limitations, and availability.
7. ORDER ACCEPTANCE AND ORDER CANCELLATION
Submitting an order, deposit, or payment request does not necessarily mean that E-LAND Mobility has accepted the order.
We reserve the right to refuse, limit, cancel, or modify an order for legitimate business reasons, including:
-
Product availability;
-
Pricing or listing errors;
-
Inventory limitations;
-
Suspected fraud or unauthorized transactions;
-
Incorrect customer information;
-
Suspected unauthorized resale;
-
Manufacturer availability or discontinuation;
-
Shipping or delivery limitations;
-
Failure to satisfy applicable financing or payment requirements;
-
Other circumstances permitted by applicable law.
If we cancel an order for a reason requiring a refund, the applicable amount paid will be refunded in accordance with applicable law and our policies.
8. DEPOSITS, SPECIAL ORDERS, AND PRE-ORDERS
Certain products may be offered as deposits, special orders, or pre-orders.
A deposit or pre-order may cause E-LAND Mobility to place an order with a manufacturer or supplier specifically for the Customer.
8.1 Estimated Arrival Dates
Any stated arrival, shipping, production, or delivery date for a pre-order or special-order product is an estimate only unless expressly identified in writing as a guaranteed date.
Manufacturer production schedules, inventory availability, transportation, customs, supply-chain conditions, component availability, weather, carrier delays, and other circumstances may affect the estimated arrival date.
E-LAND Mobility does not control the manufacturer's production or shipping schedule.
8.2 Manufacturer Changes
The manufacturer may change specifications, components, colors, graphics, features, pricing, or other aspects of a pre-ordered product.
Where reasonably possible, E-LAND Mobility will communicate material changes to the Customer.
8.3 Pre-Order Cancellation
By placing a pre-order, the Customer acknowledges that E-LAND Mobility may commit funds, inventory, purchasing capacity, or other resources to obtain the product.
Pre-orders and deposits are therefore subject to the applicable Return & Refund Policy and any specific pre-order disclosure presented to the Customer at the time of purchase.
However, nothing in these Terms is intended to waive or limit any cancellation, refund, or other rights that cannot legally be waived, including rights that may apply under applicable federal or state law.
For internet, telephone, or other covered merchandise orders, E-LAND Mobility will comply with applicable federal requirements concerning shipment delays and refunds. If E-LAND Mobility cannot ship within the applicable promised or legally required timeframe, the Customer will be provided any cancellation, delay, consent, or refund rights required by law.
8.4 Price Changes
Where a manufacturer changes the price of a pre-order product before fulfillment, E-LAND Mobility may notify the Customer of the updated price and applicable options.
No provision of this section authorizes E-LAND Mobility to impose a material price increase contrary to applicable law or an express written agreement with the Customer.
9. DEPOSITS AND BALANCE PAYMENTS
Where a product requires a deposit, the deposit amount, remaining balance, payment deadline, and applicable cancellation or refund terms will be disclosed to the Customer.
Failure to timely pay a remaining balance may result in cancellation, storage charges, loss of promotional pricing, or other consequences disclosed in the applicable transaction documents and policies, subject to applicable law.
Customers are responsible for reviewing their invoice and transaction documents before completing a purchase.
10. FINANCING AND THIRD-PARTY PAYMENT PROVIDERS
E-LAND Mobility may offer financing through independent third-party financing companies.
Unless expressly stated otherwise, E-LAND Mobility is not the lender.
Approval, interest rates, payment schedules, credit decisions, finance charges, account servicing, and financing agreements are controlled by the applicable financing provider and are subject to that provider's separate agreement and terms.
A Customer's financing agreement is separate from these Terms.
E-LAND Mobility does not guarantee financing approval or any particular financing terms.
If a financing provider approves a transaction, the Customer remains responsible for complying with the financing agreement, regardless of later disputes concerning the product, except to the extent otherwise required by applicable law or agreed to in writing.
11. RETURNS, REFUNDS, AND EXCHANGES
Returns, refunds, exchanges, cancellations, deposits, and related matters are governed by E-LAND Mobility's applicable Return & Refund Policy.
Customers are responsible for reviewing that policy before completing a purchase.
Nothing in these Terms is intended to eliminate rights that cannot legally be waived.
12. MANUFACTURER WARRANTIES
Many products sold by E-LAND Mobility are covered by warranties provided directly by the manufacturer.
Manufacturer warranties are controlled by the applicable manufacturer's written warranty terms, including their eligibility requirements, exclusions, limitations, claim procedures, and coverage periods.
E-LAND Mobility does not create, extend, modify, or guarantee a manufacturer's warranty unless E-LAND Mobility expressly provides a separate written warranty.
Warranty claims may require inspection, documentation, photographs, videos, diagnostic information, proof of purchase, or manufacturer authorization.
A manufacturer's warranty may exclude or limit coverage for circumstances including, but not limited to:
-
Misuse or abuse;
-
Accidents or collisions;
-
Unauthorized modifications;
-
Improper assembly;
-
Improper maintenance;
-
Water or environmental damage;
-
Normal wear and tear;
-
Flat tires or consumable items;
-
Unauthorized repairs;
-
Failure to follow charging or storage instructions;
-
Commercial or rental use where excluded;
-
Use contrary to manufacturer instructions.
The specific manufacturer's warranty controls where applicable.
13. SERVICE, REPAIR, AND DIAGNOSTIC SERVICES
E-LAND Mobility may provide assembly, installation, inspection, diagnostic, repair, maintenance, or other service work.
Service work may be subject to separate estimates, invoices, service authorizations, and service terms.
Customers authorize E-LAND Mobility to perform the services specifically authorized by the Customer.
Additional issues discovered during inspection may require additional authorization and charges before additional work is performed, except where otherwise agreed.
Diagnostic or inspection charges may apply even when a Customer ultimately declines repair.
E-LAND Mobility is not responsible for pre-existing damage, undisclosed modifications, improper prior repairs, normal wear, or defects unrelated to the authorized service, except as otherwise required by law.
14. PRODUCT USE, SAFETY, AND ASSUMPTION OF RISK
Certain products sold by E-LAND Mobility are motorized vehicles or recreational products that inherently involve risks.
These risks may include falls, collisions, loss of control, mechanical or electrical failure, battery-related hazards, burns, property damage, serious injury, or death.
Customers are responsible for:
-
Reading and following all manufacturer instructions and warnings;
-
Inspecting the product before use;
-
Maintaining the product properly;
-
Using appropriate protective equipment;
-
Operating the product in a safe and lawful manner;
-
Understanding the limitations of the product;
-
Determining whether the product is appropriate for the Customer's intended use;
-
Complying with applicable laws, regulations, licensing, registration, equipment, and operating requirements.
The Customer assumes responsibility for risks associated with the Customer's operation, maintenance, storage, charging, transportation, modification, or misuse of the product to the fullest extent permitted by law.
Where applicable, additional product-specific acknowledgments or waivers may be required before delivery or use.
15. MODIFICATIONS AND UNAUTHORIZED USE
Modifying a product may affect safety, performance, legality, reliability, and warranty coverage.
Customers should not modify, bypass, disable, remove, or alter safety equipment, speed restrictions, electrical systems, battery systems, controllers, brakes, or other components except as permitted by the manufacturer and applicable law.
Unauthorized modifications may void or limit manufacturer warranty coverage.
E-LAND Mobility is not responsible for damage, injury, loss, or warranty denial resulting from unauthorized modifications or use, except to the extent liability cannot legally be excluded.
16. COMPLIANCE WITH LAWS
The Customer is solely responsible for determining whether a product is legal to purchase, register, insure, operate, modify, or use in the Customer's jurisdiction and intended location.
Different jurisdictions may have different requirements concerning:
-
Registration;
-
Licensing;
-
Insurance;
-
Helmets and protective equipment;
-
Age restrictions;
-
Vehicle classification;
-
Equipment requirements;
-
Road use;
-
Trail use;
-
Speed limitations;
-
Motor power;
-
Lighting;
-
Noise;
-
Emissions;
-
Off-road use;
-
Transportation and storage.
E-LAND Mobility does not represent that every product is legal for every use or in every jurisdiction.
Customers should verify applicable requirements with the appropriate governmental authority before operating a product.
17. COMMUNICATIONS AND MARKETING CONSENT
By providing your email address, telephone number, or other contact information, you consent to E-LAND Mobility using that information for legitimate business communications, including:
-
Order confirmations;
-
Receipts;
-
Shipping and delivery updates;
-
Service communications;
-
Warranty communications;
-
Appointment reminders;
-
Account-related notices;
-
Responses to customer inquiries;
-
Other transactional or service-related communications.
Where required by law, E-LAND Mobility will separately obtain consent for marketing communications.
If you elect to receive marketing communications, you may receive newsletters, promotional offers, product announcements, special deals, events, educational information, and other marketing communications.
You may unsubscribe from marketing emails at any time by using the unsubscribe mechanism provided in the communication.
Unsubscribing from marketing communications does not necessarily stop transactional, account, service, security, legal, or other non-marketing communications that are reasonably necessary to administer your transaction or relationship with E-LAND Mobility.
SMS communications, if offered, may be subject to additional consent and messaging terms. Message and data rates may apply where applicable.
18. CUSTOMER ACCOUNTS
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
You agree to promptly notify us of unauthorized access or suspected account compromise.
We may suspend or terminate accounts that are used fraudulently, unlawfully, abusively, or in violation of these Terms.
19. PROHIBITED WEBSITE USE
You may not use our website or Services to:
-
Violate any applicable law;
-
Commit fraud or facilitate fraudulent transactions;
-
Provide false or misleading information;

-
Use the Services in a manner that could damage E-LAND Mobility or other users.
We may restrict or terminate access to our website or Services for prohibited or abusive activity, subject to applicable law.
20. INTELLECTUAL PROPERTY
All website content, including logos, trademarks, graphics, photographs, videos, text, product descriptions, designs, layouts, and other materials owned or licensed by E-LAND Mobility are protected by applicable intellectual property laws.
You may not reproduce, modify, distribute, sell, publish, transmit, or commercially exploit our proprietary content without written authorization.
Product names, logos, trademarks, and other intellectual property belonging to manufacturers remain the property of their respective owners.
21. CUSTOMER SUBMISSIONS AND REVIEWS
If you submit reviews, photographs, videos, testimonials, comments, or other content to E-LAND Mobility, you represent that you have the right to provide that content and that it does not violate another person's rights.
By submitting content, you grant E-LAND Mobility a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, and distribute that content for legitimate business, marketing, advertising, and promotional purposes, subject to applicable law.
We reserve the right to remove or decline to publish content that is unlawful, misleading, abusive, defamatory, fraudulent, or otherwise inappropriate.
22. THIRD-PARTY LINKS AND SERVICES
Our website may contain links to third-party websites, manufacturers, financing companies, payment providers, shipping providers, or other services.
E-LAND Mobility does not control or guarantee third-party websites or services.
Your use of third-party services may be governed by separate terms and privacy policies.
23. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR EXPRESS WARRANTIES SPECIFICALLY PROVIDED IN WRITING BY E-LAND MOBILITY, OUR WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
E-LAND MOBILITY DOES NOT WARRANT THAT THE WEBSITE OR SERVICES WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR UNINTERRUPTED.
TO THE EXTENT PERMITTED BY LAW, E-LAND MOBILITY DISCLAIMS IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXCEPT WHERE SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED OR WHERE A WRITTEN WARRANTY EXPRESSLY APPLIES.
NOTHING IN THESE TERMS DISCLAIMS OR LIMITS A WARRANTY OR RIGHT THAT CANNOT LEGALLY BE DISCLAIMED OR LIMITED.
24. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, E-LAND MOBILITY AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE WEBSITE, SERVICES, OR PRODUCTS, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, EXCEPT TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, E-LAND MOBILITY'S TOTAL LIABILITY ARISING FROM A PARTICULAR PRODUCT OR TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO E-LAND MOBILITY FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
This limitation does not apply to liability that cannot legally be limited or excluded.
25. RELEASE AND ASSUMPTION OF RISK
To the fullest extent permitted by applicable law, the Customer acknowledges the inherent risks associated with purchasing, possessing, transporting, charging, maintaining, repairing, and operating motorized and electric products.
Any release, waiver, assumption of risk, or similar protection contained in a separate purchase acknowledgment, waiver, service authorization, or product-specific agreement is intended to supplement, and not replace, this section.
No provision of these Terms is intended to waive rights or claims that cannot legally be waived.
26. INDEMNIFICATION
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless E-LAND Mobility and its owners, officers, employees, agents, and affiliates from third-party claims, damages, losses, liabilities, costs, and reasonable attorneys' fees arising from:
-
Your violation of these Terms;
-
Your violation of applicable law;
-
Your misuse of a product;
-
Unauthorized modifications to a product;
-
Your fraudulent or unlawful activity;
-
Your violation of another person's rights.
This provision does not require indemnification to the extent prohibited by applicable law.
27. CHARGEBACKS AND PAYMENT DISPUTES
If you believe a charge is incorrect, you agree to contact E-LAND Mobility promptly so that we may investigate and attempt to resolve the matter.
Nothing in this section prevents a Customer from exercising rights provided by applicable law or by a payment-card issuer.
If a Customer initiates a payment dispute or chargeback, E-LAND Mobility may provide the applicable payment processor, financing company, or financial institution with transaction records and other documentation reasonably necessary to respond to the dispute.
Such documentation may include invoices, receipts, signed acknowledgments, order records, communications, delivery records, service records, inspection records, photographs, and other transaction information.
28. SHIPPING AND DELIVERY
Shipping and delivery are subject to our applicable Shipping Policy.
Once a product is transferred to a carrier, delivery may be affected by circumstances outside E-LAND Mobility's control.
Customers are responsible for providing accurate shipping information.
Additional charges may apply where incorrect or incomplete shipping information results in additional carrier costs.
Nothing in this section limits rights provided under applicable shipping, consumer-protection, or other laws.
29. FORCE MAJEURE
E-LAND Mobility will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including manufacturer delays, supply-chain disruptions, transportation delays, carrier interruptions, natural disasters, severe weather, fire, government action, labor disruptions, utility failures, cyber incidents, or other extraordinary circumstances.
Where applicable law imposes obligations notwithstanding such circumstances, E-LAND Mobility will comply with those requirements.
30. TERMINATION AND SUSPENSION
We may suspend or terminate access to our website or Services where reasonably necessary due to fraud, abuse, unlawful activity, security concerns, violation of these Terms, or other legitimate business reasons.
Termination does not eliminate obligations that accrued before termination.
Sections that by their nature should survive termination, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, dispute provisions, and governing law, will survive to the extent permitted by law.
31. DISPUTE RESOLUTION
Before initiating formal legal proceedings concerning a dispute, the parties are encouraged to contact one another and attempt in good faith to resolve the matter.
Nothing in this section prevents a party from seeking emergency relief or exercising rights that cannot legally be waived.
Arbitration
To the extent permitted by applicable law, disputes arising from or relating to these Terms, a transaction, or the use of our products or Services may be subject to binding individual arbitration pursuant to a mutually applicable arbitration agreement.
Any arbitration provision presented to the Customer as a separate agreement, checkout term, purchase acknowledgment, or other transaction document will govern according to its own terms.
Nothing in these Terms is intended to eliminate rights that cannot legally be waived.
32. NO CLASS ACTIONS TO THE EXTENT PERMITTED BY LAW
To the extent permitted by applicable law and any applicable arbitration agreement, claims between E-LAND Mobility and a Customer will be brought individually rather than as a class, collective, or representative action.
This provision does not apply where such a waiver is prohibited or unenforceable under applicable law.
33. GOVERNING LAW
These Terms will be governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except to the extent federal law or mandatory consumer-protection law requires otherwise.
34. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
35. NO WAIVER
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
36. ENTIRE AGREEMENT
These Terms, together with applicable policies, transaction documents, purchase acknowledgments, warranties, service authorizations, financing agreements, and other written agreements applicable to a particular transaction, constitute the agreements governing the applicable relationship or transaction.
No oral statement by an employee or representative modifies these Terms unless confirmed in writing by an authorized representative of E-LAND Mobility.
37. ELECTRONIC RECORDS AND SIGNATURES
To the extent permitted by law, electronic orders, electronic signatures, checkboxes, acknowledgments, emails, invoices, receipts, and other electronic records may constitute evidence of the Customer's agreement, authorization, or transaction.
Customers should retain copies of their transaction documents and applicable policies.
